Daniel Shay is the founding principal attorney of Shay Legal APC. It’s his passion for helping protect individuals’ consumer rights and defending against abusive businesses that led him to found the law firm. He believed that the freedom of operating his own practice would allow him to better serve and represent his clients and their interests.
Daniel lives with his wife and two children in San Diego and takes advantage of the many outdoor activities that the state of California has to offer, including camping, hiking, and fishing.
While San Diego is Daniel’s current home, his ties to the city run deeper, as he also received his Juris Doctor Degree from Thomas Jefferson School of Law here in the city. He holds a license to practice law in California (State Bar Number 250548), as well as a license to practice in Washington, DC (State Bar Number 1660263).
Daniel’s desire to see consumers find justice from businesses that violate their rights has always guided his work. Since founding his practice in 2008, he has represented thousands of consumers in many types of claims and recovered millions on their behalf. While many other lawyers might make consumer rights merely a part of their practice, Daniel has made it the focus of his. He believes that every consumer deserves to be treated with respect and dignity by businesses, and he strives to do the same in his own treatment of his clients.
Shay Legal APC, under the guidance of founding principal attorney Daniel Shay, has a passion for defending consumers’ rights. Whereas other firms involved in consumer rights law might take on both consumers and businesses as clients, we focus exclusively on working with consumers. It would be disingenuous to claim a passion for defending consumers and holding businesses to account for their violations if we were also defending those businesses. Our passion lies in seeking justice and protecting individuals from powerful companies.
There’s a tremendous power imbalance that exists between consumers and the businesses they must do commerce with. In many cases, consumers’ options are limited after their rights are violated. For instance, there’s no alternative to the big three credit reporting agencies. You can’t ask that a lender ignore an agency that’s made an error on your report or failed to remove fraudulent records. Therefore, identity theft, credit reporting agency error, and fraudulent transfers could have a devastating effect on your financial circumstances to no fault of your own.
This disparate power dynamic means that consumers are at the mercy of institutions, from banks to corporations, credit reporting agencies, or even telemarketers, who may use a number of techniques to get around blocked numbers and other means of trying to avoid their intrusions.
Consumer rights protections are meant to address this power imbalance. California, in particular, has one of the strongest sets of laws and regulations that are designed to protect the rights of consumers. The Unruh Civil Rights Act protects consumers from discriminatory business practices, and the California Invasion of Privacy Act makes it illegal to record any conversation without the consent of all parties involved. Furthermore, California’s Unfair Competition Law strives to prevent unfair or fraudulent business practices from occurring. These acts make it easier for Californians to protect themselves and punish institutions for unjust practices.
Despite the protections for consumers that exist at both the federal level and within the state of California, the differences in power can often seem even more evident when you try to hold powerful institutions accountable. They are often able to hire teams of powerful lawyers prepared to answer any accusations and fight back against claims that they violated any laws or regulations.
No matter how powerful businesses and corporations may be, consumer rights cases are matters of justice. This means that it doesn’t matter how many attorneys or how much money an institution has. Nor does it matter how impressive or intimidating they are. The job of the court in executing justice is to blindly consider the facts of the case and how they should be addressed. If a business or institution has violated your rights, justice should be served.
The facts of the case are all that should matter in a consumer’s rights claim. Therefore, it’s crucial for consumers to hire skilled consumer rights attorneys who are ready to make a strong case for them and their interests. At Shay Legal APC, we sincerely believe that customers with a legitimate case against any institution should be well-represented and have a strong advocate to argue on their behalf. We strive to do the same for every client we represent.
When we take on a client, we make thorough preparations for the case ahead. We can investigate their case and ensure that we have a strong collection of evidence, documentation, and facts to support their claims and position. We also can bring a depth of legal and technical knowledge to the case.
